| HC grants four weeks time to respondents for placement of sanction order | | Creation of new posts in HC case | | Jammu, March 10 In a LPA filed by Law Department and Others Vs High Court Staff Welfare Association, Division Bench of J&K High Court Jammu Wing comprising Justice Nirmal Singh and Justice JP Singh, directed that in case sanction order is not placed on record then Commissioner/ Secretary Finance and AH Kochak Secretary Law should appear in person on next date of hearing. This significant order was passed in a LPA filed by the High Court Staff Welfare Association seeking direction to the State Government for according sanction for creation of new posts, which were referred by the High Court Registrar General in 1996. Division Bench, after hearing Advocate General Mr. AH Naik with AH Kochak Law Secretary and Advocate Sunil Sethi with Joginder Singh General Secretary High Court Staff Welfare Association, observed that Advocate General made a statement for creation of the new posts for which the reference has been made by the High Court, the matter is under process, he seeks time to place on record the sanction order. Upon this, DB said that taking into consideration the statement of AG that the matter is being processed and some formalities are likely to be completed, Court is not inclined to adjourn the matter further because the respondents are taking adjournments on the one excuse or the other. However, in the interest of justice and as the AG has made a statement that the sanction order is under process, four weeks more time to the respondents is granted as prayed for. The respondents are directed to place on record the sanction order on or before the next date of hearing. In case sanction order is not placed on record then Commissioner/Secretary Finance as well as AH Kochak Law Secretary should appear in person on next date of hearing.
