Rajouri, Sept 12: A special police officer (SPO) has been sentenced to life imprisonment by the court of Sessions Judge AK Sharma for killing his colleague constable Mohd Ishaq in February,2005. Accused Mohd Shakoor and deceased constable Mohd Ishaq were posted at police picket at Choudhry Narh in the vicinity of Rajouri city. Ch Liyakst Ali contested the trial on behalf of accused while state was represented by M Mir , public prosecutor (PP) On 31st January the accused and the deceased had heated exchange following which the deceased had slapped him. The accused SPO in a rage was looking for a chance to take the revenge with the deceased. On February 1, accused Mohd Shakoor was on sentry duty at police picket (at Choudhrinar) along with constable Zaffar Javed. He was carrying SLR gun bearing No.974 and Zaffar was holding LMG. The deceased went to the picket to check the guard at LMG where accused Mohd Shakkor was sitting in civil dress holding SLR. Mohad Ishaq , the deceased objected to perform the duty in civil dress which again lead to exchange of some hot words between the accused and deceased. Other policemen also came out from the post and in-charge asked the deceased to come back. The accused followed the deceased hurling abuses at him. Mohd Ishaq objected to that and the accused, who was nursing ill-will against the deceased, opened fire from his SLR gun which hit the deceased at his chest resulting in his instant death. After completing the investigations police produced challan against the accused in the court of learned CJM who committed the same to the court of Sessions Judge for trial and the accused was formally charge-sheeted by the court on May7, 2005 for commission of offence punishable under section 302 RPC. On September 9, the accused was held guilty by the court for commission of offence under section 302 RPC. Delivering punishment Sessions Judge said that the manner in which the accused killed the deceased doesn't call for any lenient view to be taken in his favour. Nevertheless this is not a 'rarest of rare case', hence , extreme penalty can't be awarded. He is , therefore, sentenced to undergo rigorous life imprisonment and pay a fine of Rs 20000. In default of payment of fine he (accused) shall further undergo simple imprisonment for three months which will be concurrent with life imprisonment. |
