| Cop gets lifer for killing colleague | | | Et Report
Jammu, Sept 12: Principal Sessions Judge Rajouri Ashok Sharma awarded rigorous life imprisonment to SPO Mohd Shakoor S/o Wazir Mohd R/o Rital (Choudhary Nar), Tehsil& Distt. Rajouri for killing his colleague Mohd Ishaq.
According to the police case, on Ist February 2005 at 23:45 Hrs, a docket dispatched by ASI Dwarka Nath, In-charge Police Picket Choudhary Narh was received through constable Zaffar Javed stating therein that he is the In-charge of Police Post Choudhary Narh and about fifteen police personnel perform their duties under his supervision. At about 10:45 Hrs SPO Mohd Shakoor who was performing 'Santry' duty at the Picket has killed Constable Mohd Ishaq by firing at him with his official Self Loading Rifle (SLR). On the receipt of the said information, case FIR No.43/2005 for offence u/section 302 RPC was registered with the police station Rajouri and the investigation was assigned to SI Mohd Khushal, who prepared the site plan after visiting the spot. The bloodstained and plain clay was collected from the spot. The fired bullet and the empty were also seized and resealed on spot. The SLR bearing butt No.974 produced by the complainant was also seized and resealed. 12 live rounds of the SLR rifle were also separately seized. Two magazines of SLR containing 19 rounds and 18 rounds respectively were also recovered from the accused and seized on spot. The dead body of Mohd Ishaq was handed over to his legal heirs after conducting the postmortem. The statements of the witnesses were recorded and the accused was apprehended. After completion of investigation challan was presented.
The Court observed that No doubt the accused caused the death of deceased by firing from his official SLR but the circumstances show that it is not an event that prompted him to kill the deceased instantaneously. From the facts of the case, it becomes amply clear that the accused nourished a grudge with him as the deceased had a tiff with him a day earlier and slapped him. The accused was in the look out of an excuse which came to him when the deceased came checking for police personnel on duty and he started arguing and finally killed by firing from the SLR resultantly the bullet pierced through his chest. The manner in which the accused killed the deceased does not call for any lenient view to be taken in his favour. Nevertheless this is not a case of specie "rarest of rare case", hence; extreme death penalty cannot be awarded to him. He is, therefore, sentenced to undergo rigorous life-imprisonment and pay a FINE OF Rs.20,000/-. I
n default of payment of fine he shall further undergo simple imprisonment for three months, which will be concurrent with life imprisonment. However, the sentence shall be executed only after it is confirmed by the High Court. (JNF) |
