Thief to serve 4 year term

Jammu, Sept 12 (JNF): Judicial Magistrate Mahanpur Sandeep Gandotra today awarded four years imprisonment to Surjeet Singh for broad day theft and one year to associate Mohan Lal.
According to the police case that on 02.05.2008 at about 4 pm, the complainant Ram Singh S/o Duni Chand R/o Adhat Tehsil Basohli had presented a written complaint against the accused Surjit Singh alias Pinku alongwith endorsement made by SDPO Basohli for registration of case under law. In the complaint, it was stated that on 06.04.2008, the complainant was not at home and one accused Surjit Singh alias Pinku S/o Mohan Singh R/o Mahanpur came to his house and stole cash of Rs. 7900/-, one golden Nath weighing 8 masa, two necklaces (one weighing 32 grams and other weighing 22 gms) from the house of complainant. When the accused committed theft, the wife of the complainant was at Mahanpur in connection with shopping and his son was also not at home. On 06.04.2008 when wife of the complainant came back to home she found lock of iron box open in which complainant had put his money and golden ornaments. On inquiry by his wife, it was found that accused Surjit Singh was in the house of the complainant when wife of complainant was at Mahanpur. The complainant is working at Bangalore and he had received message regarding the theft only few days back. As such, there is delay in filing the complaint. Lastly, it is requested that enquiry may kindly be conducted and stolen articles may kindly be recovered. On receipt of this complaint, FIR No. 47/08 for offences u/s 454/380 RPC was registered and investigation was handed over to Kamal Dev ASI Incharge Police Post, Mahanpur.
The court after hearing hearing both the sides observed that the prosecution has succeeded in proving its case against the accused persons beyond all reasonable doubts. The prosecution has proved it by cogent and reliable evidence that accused Surjit Singh had committed theft of gold ornaments in the house of complainant. As such, accused Surjit Singh @ Pinku S/o Mohan Singh r/o of Mahanpur, Tehsil Basohli District Kathua is convicted for offences u/s 457 RPC and he is sentenced to undergo simple imprisonment for a period of two years and to pay a fine of Rs.2,000/- under section 457 RPC, in default whereof he shall undergo simple imprisonment for two month. He is also convicted for offense u/s 380 RPC and is sentenced to undergo further simple imprisonment for a period of two year and to pay a fine of Rs, 2,000/- in the offence under section 380 RPC and in default of the payment of fine he shall undergo simple imprisonment for one month. As both the offences were simultaneously committed, so punishment by way of imprisonment for both the offences shall run concurrently. Accused Mohan Lal S/o Sudesh Kumar r/o of Mahanpur, Tehsil Basohli District Kathua is also convicted for offence u/s 411 RPC and he is sentenced to undergo simple imprisonment for a period of one years and to pay a fine of Rs.2, 000/- under section 411 RPC, in default whereof he shall undergo simple imprisonment for one month.
