| Minor Girl allegedly kidnapped and rape produced in the Court | | HC after recording the statement send the victim to Nari-Niketan | | Jammu, August, 03 :- As per the direction of the High Court a victim of kidnapping and rape was produced by the RS Pura Police in the High Court. Justice Nirmal Singh of J&K High Court Jammu Wing today directed to produce the girl before Chief Judicial Magistrate for recording her statement.
Chief Judicial Magistrate Jammu Mr. Sanjay Dhar recorded the statement of the girl in his office chamber and returned the file to the High Court as per the direction of the High Court. The High Court sent girl back to Nari-Niketan RS Pura where from she was brought to the Court.
The direction of High Court has been passed in a petition filed by Tarseem Lal and his wife Nirmla Devi r/o Bhau Tehsil RS Pura in which they prayed for issuance of a direction to the police authority including SDPO RS Pura for registration of FIR against Parsem Singh alias Natha, Virender Bhau his son r/o Bhau Tehsil RS Pura u/s 366/376 RPC.
In the petition it was submitted that the minor daughter of the petitioner when she was at the age of seven years was working in the house of respondents for domestic purpose in the month of April 200, Petitioner went to the house of Parsem Singh to know about her minor daughter and after reaching their home found that the daughter was missing on asking her whereabouts respondent could not give satisfactory reply to the petitioner. In the petition it has been submitted that the petitioner approached IGP Jammu on April 9, 2006 with a request to investigate and locate the daughter of petitioner, the IGP forward the application to SSP border for further investigation but nothing was done, the petitioner than approached DIG Crime Branch Jammu for locating the daughter of the petitioner but the DIG Crime Branch also forwarded the application to SSP Border. After the direction of the authorities, the local police called Parsem Singh alias Natha and after investigation he disclosed the whereabouts of the minor daughter, which was recovered and the custody was handed over to the petitioner. It was alleged in the petition that the local police without investigating the matter further and conducting medical examination of the minor daughter of the petitioner close the investigation of the case particularly when there were allegations of committing rape upon minor daughter of the petitioner.
In the petition it has been further alleged that accused Parsem Singh alias Natha and Virender Bhau made another effort to take away the minor daughter and get her aborted. Such move of respondents in connivance with some influential persons, one of them had been assuring the minor daughter to take her to Italy for her betterment. The respondents again succeeded in their mission and the minor daughter went missing. In the meantime the petitioner again approached the concern police but no response was shown, he came to know only the whereabouts of their daughter when she was sent to Nari-Niketan through Supt Central Jail Jammu.
When the daughter of the petitioners was not medically examined the petitioner approached CJM Jammu with an application for medical check-up of their minor. Chief Judicial Magistrate Jammu vide order dated May 26, 2006 directed Medical Supt GMC Jammu to conduct the medical examination of the minor. The petitioners came to know from the medical report that minor daughter is pregnant of eight weeks but also confirmed that she has been regularly sexually assaulted. The petitioner prayed before the Court for registration FIR against Parsem Singh and Virender Bhau u/s 366/376 RPC for committing rape upon minor daughter, who has become pregnant. According to the police source that the girl, was roaming in the General Bus-Stand area in suspicious circumstances was apprehended by the Bus-Stand police and after investigation she was sent to Jail where from she was sent to Nari-Niketan RS Pura where from she was brought by the RS Pura in the High Court.
