| Court asks Raman, Yaqoob to explain position | | One plot sold to two persons | | Jammu, March 19 Sub-Judge Jammu Mr. RK Wattal, in a civil suit issued notice to Raman Mattoo and Mohd Yaqoob partners of Asra Builders to explain their position. Tirloki Nath Kachroo, a Kashmiri migrant filed a suit for permanent prohibitory injunction and submitted in the petition that applicant is lawful owner of plot measuring 6 marlas under Khasra No 123 min situated at Channi-Kamala Jammu. The plot 21-A falling in private housing colony, village enclave, was purchased by him from Asra Builders, partnership concern of Raman Mattoo and Mohd Yaqoob. It also alleged that non-applicant Mrs. Khursheeda Maqbool w/o Mohammed Maqbool Bhat r/o Raj-Bagh Srinagar, under the grab of ownership of 5 ½ Marlas of land under the same Khasar purchased from Mohd Yaqoob, is bent upon interfering and encroaching upon the suit land. Sub-Judge, after hearing Advocate Ajay Gandotra appearing for the applicant and Adv PN Bhat appearing for the non-applicant, observed that it will be proper to array colonizer Raman Mattoo and Mohd Yaqoob as party defendants in the case and accordingly issued notice for their appearance before the court. The Sub Judge also directed them to file their written statements and objections to the rival claims of the parties to the suit plot and explain their position and also show cause as to why proceedings under law be not initiated against them, if same suit plot is shown to have been sold by them to the parties at different times. It is worthwhile to mention here that the applicant claims that he had purchased the said plot through attorney Raman Mattoo colonizer on February 3, 1989 whereas the non-applicant shown to have purchased it in the year 1999. Court after considering the claims of the parties issued notice to the partners of Asra builders.
