| Director Horticulture directed to entertain applications of petitioners | | Fate of 154 Horticulture employees hangs in balance | | JAMMU- AUG 3 It is an irony that the fate of all those unemployed educated youth who had been adjusted in various government departments in 1996 and onwards by the duly elected government continues to hang in balance. While in certain cases, such employees appointed without inviting proper applications or following proper recruitment procedure have been regularized but more than 40,000 appointees, including 154 in Horticulture department, in similarly placed circumstances, have yet to be regularized. It may be recalled that in the year 1995 a promise was held to the educated unemployed youth that in case they help in restoration of democracy in the state they will be provided with government jobs. Unemployed educated youth without caring for their life came out against the militants’ verdict and wholeheartedly supported in getting the democratically elected government installed in the state in 1996. The government in fulfilling its promise appointed more than 40,000 persons including 154 as class IV employees in Horticulture and Agriculture Departments. According to the details available, the government appointed 417 persons on class IV posts in the Education Department without any advertisement or any criteria or following any recruitment rules and those who challenged the said appointments were made to withdraw only those writ petitions in which they was a stay and appointed the said petitioners also whereas a number of petitions in which they was no stay are still pending for disposal. Despite hue and cry, the government has not been able to frame any policy to tackle the problem and decide the fate of those who were appointed by the then government. It is pertinent to mention here that the issue also dominated in the Budget session of the State Legislature in last February and the Speaker vide order NO LA/8729-50 dated March 13, 2006 constituted a committee to look into the appointments made irregularly in violation of rules/laws in all the departments. However, despite lapse of nearly five months, the report of the committee has not been made to public. The reports said that 154 appointments were made in Horticulture and Agriculture Departments against the class IV vacancies including Malies, who were imparted Malies training in 1999-2000. In the year 2005 the Agriculture department vide its order NO 215-Agri of 2005 dated August 16, 2005 constituted a committee for making selection against the posts held by them whereas the posts held by similarly appointed persons in other Departments in the State were neither touched nor their posts advertised. It is not understood why the government is adopting double standards and it would be better if the government decides the future of such appointees once for all. It is worthwhile to mention here that Farooq Ahmed and several others had filed a writ petition in the High Court challenging these appointments. The petitioners in their writ petition had prayed that all these appointments made without following the recruitment rules be dispensed with and the vacancies held by them should be advertised for regular selection. The court after hearing issued notice to the State government and passed interim directions to the respondent Director Horticulture Department Jammu to entertain applications of the petitioners and allow them to participate in the selection process, provided they possess the requisite qualification as prescribed in the recruitment rules for the posts. Their result, however, shall not be declared till the next date of hearing of the case, the Court had directed in its interim order.
