Jammu, Nov 7: Presiding Officer Sanjeev Gupta Fast Track Court today awarded seven years rigorous imprisonment and fine Rs 25000/- to Balwan Singh s/o Shamsher Singh in rape case. Court further direction that in case of fine amount is realized from the convict than an amount of Rs 20,000 shall be paid to the victim as compensation who had suffered to the act of the convict. According to the police case that on October 7, 2008 prosecutrix along with her husband approached the police station Khour and made a written report with the allegations that at 11:00 AM on the same day, she along with her sister-in-law went out of their house in order to threw the cow dung in their land over which paddy crop was grown and after doing so, both of them started cutting grass in the field. In the meantime accused came on spot, caught hold her and forcibly fell her down in the field and committed sexual intercourse with her against her consent. On this police registered a case and after completion of the investigation presented challan in the court. Presiding Officer Sanjeev Gupta after hearing Additional Public Prosecutor GS Charak for the state observed that the rape cases and cases relating to crime against Women have alarmingly increased in recent time. The social impact of the crime particularly when it relates to offences against women cannot be lost sight of and per se it requires exemplary treatment. Any liberal attitude by imposing meagre sentences or taking too sympathetic view merely on account of economic condition of a person or other irrelevant considerations will be result wise counterproductive in the long run. It is the duty of the court while awarding punishment to impose appropriate punishment so as to respond to the society's cry for justice against such criminals. Public abhorrence of the crime needs a reflection through the courts verdicts in the measure of punishment. The courts must not only keeping in view of the rights of the criminal but also the rights of the victim of crime and the society at large while considering punishment. With these observations Court awarded seven years rigorous imprisonment and fine Rs 25000 to Balwan Singh who was facing trial in the rape case for the last five years. (JNF) |
