| CBI presents challan against tout of pass-port office. | | | Jammu, March 22 Central Bureau of Investigation today filed a challan against Haji Mohammed Fazal in the Court of Chief Judicial Magistrate here for demanding gratification from Basharat Hussain Shah of village Gursai Tehsil Mendhar District Poonch, who had applied for pass-port in the pass-port office Jammu, but did not get the passport. Basharat Hussain in his complaint stated that on November 29, 2006 he visited pass-port office Jammu and contacted Bakshi Singh the then Passport Officer Jammu to ascertain the status of his pass-port, who asked him to submit an affidavit. Accordingly on submission of the affidavit the next date Bakshi Singh asked him to contact Haji Mohammed Fazal. Accordingly he met Haji, who demanded Rs 5000 for issuing the passport and finally the deal was clinched at Rs 3000 of which Rs 2000 had to be given to Bakshi Singh and remaining Rs. 1000 to Haji. On the complaint, CBI constituted a team and laid a trap and caught Haji Mohammed Fazal. After completion of the investigation presented challan in the court. During the course of investigation, the criminal liability against Bakshi Singh could not be established as he neither accepted the bribe amount nor the recovery of the same was made from him and as such charge-sheet against him could not be presented in the court of law, however, his concerned department has been requested for initiating action against him as deemed fit for on the omission and the commission found on the part of Bakshi Singh. The allegations against accused Haji Mohammed Fazal are prima-facie established and the challan was presented in the Court of CJM. JNF
