Four accused sentenced to five years imprisonment

Additional Sessions Judge Reasi Mr. Rakesh Sagar Jain today awarded five years imprisonment and fine of Rs 1000 each to accused Abdul Latif s/o Mohd Ibrahim r/o Basan, Hafiz-ullaha s/o Jamal Din r/o Chakras, Esah s/o Mohd Naik r/o Dimi Badun and Nawab Din s/o Mohd Din lone r/o Dimi Budan all of Tehsil Mahore u/s 7/25 Arms Act.
Additional Sessions Judge in the 34 pages judgment, after hearing Additional Public Prosecutor MM Sharma appearing for the state and Advocate AG Bhat appearing for the accused on the quantum of the sentence, observed that Advocate AG Bhat appearing for the accused persons argued that the accused are young persons and are not habitual offenders and there is no record of the accused being involved in any criminal activities and so a lenient view be taken. On the other hand APP MM Sharma has stated that in the present case the accused persons were in possession of prohibited arms and ammunitions for the purpose of using them against the country. In the normal circumstances, no person would keep such type of prohibited arms and ammunition in his possession as such a serious view be taken in the matter.
Additional Sessions Judge said that in the present case there is no evidence to show that accused have any criminal tendency. There is also no evidence on record to show that the accused are a menace to the society. Keeping in view the view the fact and circumstances of the case accused are sentenced to imprisonment for period of five years besides a fine of RS 1000 u/s 7/25 Arms Act.
