| Accused sentenced to five years’ imprisonment | | | Jammu, March 24 Presiding officer TADA/POTA/ 3rd Additional Sessions Judge Jammu Wani ND today awarded five years’ imprisonment to Romesh Nishad r/o Azam Garh (UP),who was arrested by the railway police while trying to commit theft in the Sattawadi Express by administering intoxicant to the passengers of the said train. Wani ND, after hearing APP Gulzar Singh Charak appearing for the police and the accused in person, held that the accused has been brought by the Punjab Police from Central Jail Jullandhar, and after hearing both the sides and also perusing the case dairy and challan presented by the Railway Police sentenced the accused to three years imprisonment u/s 328 with a fine of Rs.1, 000 and two years sentence with fine of Rs.500 under section 379/511. Both the sentences shall run concurrently, the Court ordered. The accused who was traveling in Sattawadi Express on July 6, 2004 is alleged to have administered biscuits containing intoxicants to the complainant Amod Kumar who was also traveling in the same coach of the same train with the intent to commit theft. The complainant immediately became un-conscious but the accused was caught by the railway personal red-handed and a case u/s 328/ 379/511 registered against him.
