| HC restricts CADP from opening tenders | | SRTC challenges carriage contract notice | | Jammu, March 24 Justice YP Nargotra of J&K High Court Jammu wing in a writ petition filed by J&K State Road Transport Corporation challenging the action of CAPD having issued tender notice for carriage of food grains, sugar by private carriage contractors ignoring the mandate of SRO 157, after hearing Advocate Ajay Gandotra, issued notice to Commissioner/ Secretary CAPD Department, Director CAPD Department Jammu and Assistant Director Consumer Affairs and Public Distribution Department Jammu and ordered that in the meanwhile though the tenders may be accepted by the respondents in response to tender notice March 17, 2007 but the same shall not be opened till further orders. This order is, however, subject to objections from other sides. In the petition it has been submitted that Assistant Director CPAD Department Jammu invited sealed tenders for and on behalf of the Governor J&K State from the eligible carriage contractors for carriage of food grains/ sugar to different stations of District Jammu for the year 2007-2008. The grievances projected by the SRTC in the petition is that in terms of SRO 157 all Government departments/ undertakings are required to utilize the services of truck fleet available with the JKSRTC in meeting their requirements of vehicles, but in the present case the above refereed notice for inviting tenders has been issued by the respondents ignoring the mandate of SRO 157and accordingly the High Court issued notice to the concerned and directed registry to list the case immediately after service.
