| Court issues contempt notice to SHO Kishtwar | | | Kishtwar, Mar 27 Chief Judicial Magistrate Kishtwar has initiated contempt proceedings against the Station House Officer Kishtwar for willfully disobeying the directions of the court. The contempt proceeding has been initiated on an application filed by an advocate, Sheikh Nassir Hussain, before the court alleging that the SHO failed to register FIR against a local contractor despite the directions issued by the court. The applicant alleged that he had filed a complaint before the court on 16-03-2007 in which the court directed the SHO to register a case in terms of section 156 (3) CrPC by treating the complaint as F.I.R and investigate the matter. The SHO was further directed by the court to furnish the compliance report. It was further claimed that the copy of the complaint along with the order was dispatched to the SHO but till date neither the F.I.R has been registered as per the directions nor any investigation has been done in the matter. “It is not out of place to mention here that the contemnor, by doing so has clearly exhibited extreme lack of solicitude for the rule of law and with an unmistakable and incredible air of arrogance and defiance, he has registered the F.I.R on the basis of an annexure of the complaint that too not on behalf of the complainant and mentioned the date of information in the F.I.R as 17-03-2007”, the applicant alleged further. It was stated that the first act of the contempt on his part is willful and deliberate disobedience of court order to give undue benefits to the accused and the second amount of contempt is his deliberate and willful failure to submit compliance report and further giving wrong facts in the FIR with regard to the court order and date of information. After hearing the complainant in person, the court issued show cause notice to the SHO who has been asked to show as to why the contempt proceedings may not be initiated against him under law.
