| SC summons Home Secys of 12 States, warns issuance of warrants | | | NEW DELHI, MAR 28
Peeved at the non-compliance of its earlier order regarding prisoners languishing in jails, the Supreme Court today diirected the personal appearance of Home Secretaries belonging to 12 States.
A bench, of Justices H K Sema and V S Sirpurkar, warned that it would issue bailable warrants against the officials to secure their presence if they fail to appear before it on April 24.
The bench passed the order after taking a serious view of the non-compliance of its January 24 order, wherein it had directed 13 States to file their affidavits on a PIL which claimed that thousands of life convicts were languishing in jails beyond the "stipulated" 14 years imprisonment period.
The states, whose Home Secretaries have been summoned, are Andhra Pradesh, Haryana, Punjab, Goa, Karnataka, Rajasthan, Uttarakhand, Jammu and Kashmir, Madhya Pradesh, Tripura, Meghalaya and Nagaland.
In its earlier order, all these States, besides Assam were directed by the Bench to file their affidavits within eight weeks. It also directed that in the event of the State Governments not filing the same, the Home Secretaries of the defaulting States should personally appear for an explanation.
However, on Wednesday when the matter came up for hearing, the 12 States neither filed the affidavits nor did the Home Secretaries appear. Though Assam did not file the affidavit, its Home Secretary was present and offered to comply with the order by evening. |
