| Jammu, Jan 24 : In yet one more case prosecution failure leads to acquittal of Narco Smuggler as a number of contradictions in the version of the witnesses. Principal Sessions Judge Kathua AK Koul has acquitted one Mohd Shafi S/O Babu Din R/O Ward No.3, Kathua who was arrested by the police in July 2009 as prosecution failed. Principal Sessions Judge Kathua AK Koul after going through through the charge-sheet filed by the police and statements of the witnesses observed that number of contradictions in the version of the witnesses and even if the oral evidence has some merit, still the conviction of accused is not possible because of the vital infirmities/lapses reproduced above. With these observations court acquitted the accused from the charges leveled against him. According to the police case that on 13/07/09, a tip was received in Police Station, Kathua, that accused was indulging in illegal trade of narcotic substances, which he was importing from neighboring State of Punjab. On the basis of this information, a case was registered and investigation started. Accused was apprehended near Degree College, Kathua, and from his possession 490 parvan spas capsules were recovered. After completion of investigation challan was presented. (JNF) |
