| Promotion of 107 AE (Electric) challenged | | HC directs respondents to consider petitioners for promotion | | JAMMU, March 29 Justice JP Singh of J&K High Court Jammu wing in a writ petition filed by the batch of Junior Engineers of PDD, aggrieved by the orders of PDD dated July 30, 2004 and September 29, 2004, adjusting 107 private respondents as Incharge Assistant Engineers Electric in their own pay and grades ignoring the SRO 126 of 1994, has directed State through Commissioner/ Secretary PDD, Power Development Commissioner and Chief Engineer M&RE Wing Jammu to consider the petitioners along with other eligible candidates for promotion to the post of Assistant Engineers Electric in the PDD with effect from the dates they become entitled to such consideration under the service rules and the reservation rules of 1994, governing their promotions. Justice JP Singh, after hearing Advocate Sunil Sethi appearing fore the petitioners and Deputy AG S Hakim appearing for the state, observed that Advocate Sunil Sethi submitted that with the issuance of Government order all the remained to be considered in the petition was petitioners consideration for their promotion as AE with effect from the date they become entitled to such promotion in view of the provisions of SRO 126 of 1994 and the service rules governing the promotions. Deputy AG S Hakim submitted that official respondents would have no objection in considering the petitioners case too along with all other eligible candidates while making substantive promotion against the post of Assistant Engineer and that petitioners would be considered for promotion with effect from the date they become entitled in terms of the service rules and the provisions of SRO 126 of 1994. Justice JP Singh further observed that in view of the stand taken by the Deputy AG S Hakim appearing for the state and in the light of government order dated December 29, 2006, nothing more remained to be adjudicated upon in this writ petition, because petitioners right of consideration for promotion in accordance with promotion rules and SRO 126 of 1994 stands acknowledged and admitted by the official respondents. With these observations, court disposed off petition with directions to the respondents.
