Srinagar, Jan 27 : Arguments in the fresh application for bail by Mushtaq Ahmad Peer, the former chairman of J&K Board of Professional Entrance Examination (BOPEE), who has been arrested by Crime branch of Police for his alleged involvement in CET paper selling scam of 2012, remained inconclusive today. As the arguments in the bail plea started before Special Judge Anti-Corruption Kashmir, Mohan Lal Manhas this afternoon, Peer's counsel, advocate Moulvi Aijaz produced a number of Supreme Court as well as High Court judgments in support of his contentions. "There is big man behind the conspiracy whom I cannot name but I have written a number of communications in the past to tell authorities between the lines about him."After partly hearing his arguments, the court posted the case for further arguments on February 3 (Monday). In its objection to the bail plea of Mushtaq Ahmad Peer, the Crime Branch has said that he is involved in a "heinous offence" which is non-bailable in nature as such cannot claim bail as a matter of right. "In case the accused is granted the bail, there it every likelihood of tempering of prosecution evidence and the accused will try to win over the prosecution witnesses," the Crime Branch said. It said that its investigation has established that he has committed a grave and serious offence which led to the selection of undeserving candidates for undergoing the MBBS course. While the Crime Branch opposed his bail plea, arguments could not be taken up in the application today.
Peer, who was arrested on November 23 for alleged selling of CET papers in 2012, has been chargeshteed along with 24 other persons incase FIR 24/2013 Under Section 420, 120B RPC, 5(2)d r/w (5(2) PC Act of Police Station Crime Branch. Earlier, the Crime Branch also opposed the bail to Sajad Ahmad Bhat, maintaining that he has not raised any fresh grounds to his previous bail application which was rejected by the court on December 23. |
