| PIL regarding regulation of traffic | | DB grants three weeks time to Ragunath Bazaar Committee | | JAMMU, March 30 Division Bench of J&K High Court Jammu wing, comprising Chief Justice BA Khan and Justice Nirmal Singh, in a much publicized Public Interest Litigation regarding regulation of Traffic in the J&K State, has granted further time to the committee constituted for looking into feasibility of the ban imposed on the moment of fraffic in Ragunath Bazaar to file its final report. DB, after hearing Senior Advocate DC Raina Court Counsel and Advocate General Mr. AH Naik, AAG BS Salathia and Advocate Adarsh Sharma appearing for the respondent state, issued directions to Government through nodal agency (Transport Commissioner) to file an affidavit, explaining its specific stand on the action taken on the expert committee’s report along with the relevant government decisions. DB further directed DC Jammu and Transport Commissioner to jointly examine the issue of shifting of offices and go downs of the Transport Companies, which are found within the commercial and residential areas and to comply with the orders passed by this court from time to time. DB directed Registrar Judicial to furnish a copy of this report to all departmental heads and their counsel, who are directed to examine these suggestions and take appropriate action in the matter before allotment of next parking contracts. While issuing directions, the DB observed that status report have been filed by the Transport Commissioner, SSP Traffic Jammu, Director CAPD Jammu, Director General BSF, Commissioner JMC, SE JDA and Mobile Magistrates Traffic Jammu in compliance to the directions passed by this court. In the report filed by Transport Commissioner, it is submitted that Government had already passed an order imposing ban on 25 year old vehicles. It is also claimed by the Advocate General that Government had accepted the report of the expert committee in toto , copy of which has been submitted before this court. This report also pointed out to some difficulties in shifting of offices and go downs of the transport companies from the commercial and residential areas, though some land had been allotted to these companies at Transport Nagar, even as some of these were unregistered. It is submitted that satisfactory progress has been made on the issue of uniforms, which was being enforced. With these observations, DB directed registry to list this PIL on the available Bench.
