| Accountability Commission Books PDP MLC Panditpuri in corruption case | | Commission after providing full opportunity to MLA, found him fully involved for accepting 60,000 from unemployed youth | | Jammu, March 30 In a complaint from one Sonaullah Mir, party worker of PDP against his own party MLA Mohammad Sultan Ganai alias Panditpuri of Langate Constituency, the State Accountability Commission has held as proved the allegations of corruption against the said MLA. In the complaint, Sonaullah Mir had alleged that the then MLA Mohammad Sultan Ganai (Panditpuri) had managed the employment of two sons of Ghulam Ahmad Lone, another member of PDP in the services of the state. The complainant’s main grievance was that he was allured and impressed by the influence of the said MLA and approached the MLA to arrange state employment for his sons and son-in-law. The MLA Mohammad Sultan Ganai (Panditpuri) demanded Rs 60,000 for arranging the employment in the Police department. The bribe money of Rs 60,000 was paid to MLA Panditpuri in presence of Pir Saif-ud-Din, Secretary PDP Langate, Haji Ghulam Ahmad War another member of PDP at the residence of the MLA at Baramulla. The MLA could not arrange the employment and on demand he did not returned the bribe money of Rs 60,000 to the complainant. On this grievance and specific allegation of corruption, complaint was filed before the State Accountability Commission. The Commission after a through enquiry, in which MLA Mohammad Sultan Ganai (Panditpuri) was given full opportunity to defend himself came to the conclusion that the Legislator’s demand of payment and acceptance of Rs 60,000 for arranging the employment of the son and son-in-law of complainant were substantially and conclusively established. The Commission while making recommendation to His Excellency, the Governor for taking appropriate action against the said MLA has observed as under. “To sum up the complainant has succeeded in establishing that the respondent had helped the two sons and nephew of the witness Ghulam Ahmad Lone, in getting engaged in Public Health Engineering Department and on this fact he got allured to pay Rs 60,000 to the respondent MLA Langate. It is also proved that payment of bribe money was meant to make entry of the son and son-in-law of the complainant in the service of the state and that too without going through the cumbersome selection process. The acts of the respondent, which are the basis of the present complaint, amount to the ‘allegations’ as defined U/S 2(3) and 2(7) (corruption, favoritism, nepotism, misuse of power etc.) of the J&K Accountability Commission Act 2002. The respondent has been, at the relevant time and is at this time also, a public functionary, as defined in sub-section (16) of sec.2 of the Act. All the allegations made in the complaint have been proved to the satisfaction of this Commission” |
