| Consumers forum awards compensation | | | Jammu, March 30 Divisional Consumers Protection Forum, Srinagar comprising District & Sessions Judge Mr. Rashid Ahmad Lone, Mr. M. I. Kirmani and Member Mrs. Amina Farooqi has awarded an amount of Rs. 10,000 as compensation in favour of the complainant Mr. Shabir Ahmad Bhat R/O Maisuma Srinagar who had filed a complaint against Tareen Medicate National Highway Batmallo who sold to the complainant injections on excess price. An amount of Rs. 1000 has also been awarded as cost of litigation in favour of the complainant. The complainant has purchased three Tremazac-50 mg injections with Batch No. MF-1354 from the Opposite Party on 23-12-2006 against payment of Rs. 78 when the price tag attached with the injections indicated the cost of per injection Rs. 14.19. Taking cognizance of this kind of unfair trade practice, the Forum has ordered stringent action against the seller. The seller namely Tareen Medicate Srinagar was directed to return the cost price of Rs.78 to complainant alongwith interest @ 12 percent from the date of purchase of the injections. In another similar complaint of unfair trade practice filed by Ab. Rashid Bhat against New Paragon Traders, Abi Guzar Srinagar, the Forum has directed the shopkeeper to refund Rs.210 charged from the consumer as the cost of socks against the M.R.P. of Rs. 55 of each sock shown on the price tag alongwith interest @ 12 percent from the date of purchase. An amount of Rs. 7000 has been awarded as compensation and litigation charges of Rs. 1000 in favour of the complainant for the unfair trade practices resorted by the shopkeeper. The awarded amount to be paid to the consumer within four weeks, failing which the compensation component shall also carry interest @ 6 percent from the date of order till realization. |
