First case of its kind in J&K

State Vigilance Organization (SVO) today made a history when it attached the tainted property of an Engineer under Prevention of Corruption Act. The attachment of the tainted property, first of its kind in the State, has rung alarming bells among the alleged corrupt officers.
The Organization in a swift action attached tainted property in the shape of two pieces of land measuring 14 marlas and 1 kanal and ½ marla, belonging to Abdul Hamid Shawl, then Executive Engineer PDD Bijbehara, R/o Lal Nagar Chanpora, in terms of section 8(b) of J&K Prevention of Corruption (Amendment) Act 2006 r/w P.C (Amendment) Act 2007.
A Vigilance Organization spokesman said here that preliminary enquiry established that accused Abdul Hamid Shawl, then posted as Executive Engineer PDD Bijbehara, had accumulated assets disproportionate to his known sources of income. In this connection case FIR No. 34/2006 U/S 5(1) (e) r/w/ 5(2) P.C Act was registered on September 20 last year and investigation taken up. In the course of investigation, it was revealed that the accused has constructed a palatial house with annexe at Lal Nagar Chanpora, besides purchased two pieces of land measuring 14 marlas and 1 kanal & ½ marla under survey No.2767 and 2762 at Lal Nagar Chanpora in the name of his family members. The present market value of this land is estimated to be over Rs.40 lakhs. It has also come to light that he has a cash balance of over Rs.24.53 lakhs in various bank accounts, besides another 29.67 lakhs worth bank shares, LIC and other fixed deposits. The land measuring over 1 kanal 14½ marlas under two survey Nos. 2767 and 2762 was initially purchased by the accused in the name of his wife and later transferred in the name of his father-in-law through a gift deed in order to scuttle any legal action, the spokesman said..
He said that on the basis of evidence collected during the investigation, it has come to light that the value of the assets including over 1 kanal 4½ marlas of land, acquired by the accused through corrupt practices, is highly disproportionate to his known sources of income.
Senior Superintendent of Police (BK) Vigilance Organization, Kashmir, acting under provisions of section 8(b) of J&K Prevention of Corruption (Amendment) Act 2006 r/w P.C (Amendment) Act 2007, today issued attachment order of the above land after seeking approval of the Vigilance Commissioner in order to prevent any transfer or disposal of the said property by the accused, the spokesman added.
After a recent amendment in the Prevention of Corruption Act relating to the attachment of tainted property wherein the legislature has amplified the meaning of “attachment of property” under the P.C Act, this is the first case of attachment of tainted property. Some more “attachment” cases are under process.
