| Baig appeals Jammu lawyers to call off strike | | | SRINAGAR, AUGUST 04 – Deputy Chief Minister Mr. Muzaffar Hussain Baig today appealed Jammu Bar Association (JBA) to call off their strike and adopt legal means for pressing their demands. He said there are explicit Supreme Court directions that lawyers’ strikes are illegal as they put thousands of clients to inconvenience. Responding to the issue raised by Mr. Balwant Singh Mankotia, Mr. Baig said every accused has a right of defence council under Article 21 of the Constitution and can seek transfer of the case under Article 32 also. He said denying defence to the accused by Kashmir Bar Association is also not covered under law. He said an accused can also move an application under Section 103 of the Jammu and Kashmir Constitution read with Article 216 of the Indian Constitution so that he or she is properly heard. He said such an appeal can even be made under the Cr PC. The Deputy Chief Minister said intervention on the part of the Government wouldn’t be proper, as it would raise many problems. He said it would send wrong signals. Mr. Baig hoped that JBA would call off its strike and adopt legal means to put across their point of view. Participating in the discussion, Mr. Ali Mohammad Sagar of National Conference said that it is not befitting on the part of legislature to discuss an issue which is subjudice and has rightly been handed over to CBI by the Government. He said that law must take its course and the CBI and Court should do its duty. Mr. Harshdev Singh in his speech said that every accused has a right to be heard and should have proper defence. He sought discussion of government with Jammu Bar Association on the issue. |
