Secretary to Judges of High Court seeking induction in KAS

Jammu, Feb 24 : In a petition filed by Secretaries of J&K High Court Judges seeking direction to State respondents to consider and treat the services of the petitioners category as one of the feeding service for induction into KAS, as has been done in favour of their counter parts working in the Civil Secretariat in terms of SRO386/2008, Justice Bansi Lal Bhat of J&K High Court Jammu Wing after hearing Sr. Adv Sunil Sethi with Adv Veenu Gupta appearing for the petitioners issued notice to Chief Secretary J&K, Law Secretary and Registrar General of State High Court returnable within one week.
In the petition it has been submitted that the petitioners are borne on the Cadre of Secretaries, attached with the Judges of the High Court and presently placed in the grade of Rs.10000-15200 (unrevised), which was released in their favour in October, 2008, after they were substantively promoted as Secretaries, in pursuance to the reorganization scheme of the High Court, in compliance to a judgment passed by the Writ Court upheld by a Division Bench of this Court in the year 1990-91, when the counter parts of the petitioners working in the Civil Secretariat attached with the Ministers/M.Ps/Head of Departments, were released certain benefits regarding higher pay scales with designation, and this benefit was being denied to the petitioners category working in the High Court and as no step in this regard was initiated by the Registrar General J&K High Court, regarding creation of posts in the High Court in the higher grades jeopardizing the rights of the petitioners category, a writ petition came to be filed by the predecessors of the petitioners who were then working as Personal Assistants-cum-Stenographers with the Judges of the High Court, bearing SWP No.987 of 1991 titled Mohan Lal Hakim and others v. State and ors. In the said writ petition, a prayer was made for according the petitioners therein the benefit of higher pay scale of Rs. 1900-3200 with designation of Private Secretaries with all consequential benefits as is being granted to their counter parts working in the Civil Secretariat and attached with the Ministers.
