| SCDRC directs Post Master to pay maturity amount to complainants | | | Jammu April -03 State Consumer Disputes Redreassal Commission (SCDRC) Jammu, Mr Justice G D Sharma, has directed Senior Post Master, Mubarak Mandi, Jammu and Union of India, through its Secretary Ministry of Communication, New Delhi, to pay maturity value of two Kissan Vikas Patras, along with interest @ 9 per cent per annum from the date of maturity as also the litigation charges of Rs.10000 to the complaints. The complainant, a hire purchase finance company under the name and style of Verinder Finance Pvt Ltd, had purchased Kisan Vikas Patras in 1998 for Rs.1, 80, 000 but was denied the benefits on maturity and consequently filed a complaint with the Commission. Similarly, Bhanot Finance Pvt Ltd had also purchased Kissan Vikas Patras in the year 1998 for the denomination of Rs, 1, 15,000 but on maturity was denied the benefits. The Commission, after hearing both the sides, accepted both the complaints and ordered relief for the complainants, which included payment of double of the amount of the value of the Kissan Vikas Patra, besides interest @ 9 per cent per annum on their respective payable amounts from the date of their maturity till final payments are made and the litigation charges of Rs.10000. The President in his judgment observed that before parting with the record of the complaints, ‘the Commission observed with a sense of horror and pain to find how a plea on the basis of illegal issuance of ‘Kissan Vikas Patras’ was taken on behalf of the Union of India by respondent OP Head Post Master, custodian to up hold the rights of citizens and to maintain the rule of law. A lawfully established government is not expected to enter into a contract with its citizen, which is prohibited by law and then take up the plea for depriving that credulous citizen of the interest earnings of hard earned money by retaining it for more than six years.’ ‘Such a conduct, the Commission observed, has been exhibited in this case, which sends shivers down to the spine of everybody, who is concerned with the majesty of law to prevail over the infringement of law. In other words, the case shows a sad spectable, where the fence has started eating up the crop and it can be felt what would have happened to the field, Justice Sharma further observed and hoped that Union of India, the OP NO 2, shall hold an inquiry to find out as to who was the pivotal figure for such type of alleged deals and allowed them to operate for more than six years. After reaping the benefits of such illegal ventures, volt face was committed for depriving the bonafide consumers of their due earnings, forcing them to knock the doors of the Commission, Justice G D Sharma added in the judgment.
