Justice Nisar Ahmed Kakru ,Chief Justice (acting) of J&K High Court Jammu Wing, stayed the deportation of Pak National, who came to India on February 15, 2007 on a permit.
Justice Kakru, after hearing Advocate Shahzad Azeem, issued notice to State of J&K through Chief Secretary, Union of India through Home secretary, Deputy Commissioner Rajouri, Deputy Commissioner Poonch and DIG Rajouri-Poonch Range and observed that petitioner Mirza Abbas Baig s/o Kalu Baig r/o Islamabad (Pakistan) to permitted to stay in the country till March 29, 2007.
While filling this writ petition on March 24 last a subsequent evident was brought to the notice of the Court that DC Rajouri in a communicated of March 29 last had sought extension to the stay of the subject and it was obligatory upon the petitioner to file through proper motion within one week. In the meantime, subject to objection of the other side, and till next date of hearing, there shall be stay against the deportation of the subject, Justice Kakru ordered, JNF
