| Directs treasury officers not allow financial operations by 5 SEs | | HC takes strong note of non-compliance | | Early Times Report
Srinagar, Mar 14: Taking strong exception to non-compliance of its orders regarding five Superintending Engineers in R&B Department, Jammu and Kashmir High Court today directed the treasury officers/incharge financial institutions not to allow any financial operation of Department funds under the signature of the five officers till further orders. "In order to ensure that the judgment of the court (dated 30-12-2013) is not disobeyed any further, I feel it would be in the interest of justice to direct all the Treasury Officers/ incharge financial institutions with whom these respondents (five SEs) have any financial dealings as incharge SEs not to allow or entertain any financial operations of the Departmental funds under the signature of the five officers till further orders," a single bench of the court comprising Justice Ali Mohammad Magrey said while hearing a contempt plea file by the aggrieved engineers. By virtue of the judgment dated 30-12-2013, the court had quashed placement as well as promotion as Incharge Superintending Engineers of the SEs namely, Bachan Lal, Koushal Chand, Abdul Majid Khan, Tashi Chambal and ND Khujuria. "They cannot function or carry on executing any of the powers attached to the post of SEs. Order dated 4-3-2014 transferring and posting respondents (Abdul Majid Khan) as incharge Superintending Engineer SKUAST Kashmir Srinagar is glaring indicative of the temerity on the part of the alleged contemnor (Commissioner Secretary R&B) to flout to the tilt the judgment passed by this court," Justice Magrey said. Presently, the court observed, Bachan Lal is incharge SE PMGSY Jammu, Koushal Chand (JKPCC Kashmir), Abdul Majid Khan (SKUAT Kashmir), Tashi Chambal (PMGSY Leh) and ND Khujuria (JKPCC Jammu). The bench also directed Commissioner Secretary R&B to file an affidavit alongwith her statement of facts, giving details of the financial operation conducted by the five SEs since the 30-12-2013 judgment by the court. "(The Commissioner Secretary) shall also indicate steps by the government from the date of passing the judgment for filling up of the posts of SEs on regular basis in accordance with the relevant rules". The court asked its Registrar General to fax the order to Direct Accounts and Treasuries for its transmission to the concerned Treasury officers/financial institutions for strict compliance. "The Registrar shall also fax this order to five SEs for their compliance," the court said. |
