Prosecuting failure leads to acquittal in murder case

Jammu, Mar 15 (JNF): Principal Sessions Judge Poonch Jaffer Hussain Beigh has acquitted Zooni Begum wife of Satara who was facing trial in murder of one his closed relative t. Zebo over old enmity.
After hearing both the sides, Principal Sessions Judge Poonch Jaffer Hussain Beigh observed that the prosecution case having not been proved beyond all reasonable doubts the accused is entitled to an acquittal. Accordingly the accused is acquitted by giving her the benefit of doubts, court said and added that accused be set at liberty forthwith.
According to police case a report was lodged by Abdul Satar against Satar s/o Aziza and t Zooni Begum at 9 am on 29th of March 2009 at the aforesaid Police Station, stating therein that the accused are closely related to him and are having old enmity with him. Case said that on 28/3/2009 at about 3.30 pm, in his absence, the accused persons with common criminal intention took quarrel with his wife t. Zebo, with intention to commit her murder on the basis of the enmity pushed t Zebo down from the edge, of the land situated behind his house as a result of which his wife received internal head injury and became unconscious. Some passersby on hearing hue and cry reached to spot and took her to Surankote hospital where she died. Upon this report FIR No.44/2009 for commission of offence u/Ss 302, read with section 34 RPC was registered in Police Station Surankote. During the course of investigation the police went on spot, recorded the statement of the witnesses conversant to the facts u/s 161 CrPC and also got statement of the witnesses recorded u/s 164-A CrPC. After completion of the investigation offences u/s 302 RPC was established only against the accused Zooni Begum and no offence was made out against Satar and presented challan against the accused t. Zooni Begum was presented before the Court.
