| HC seeks ATR against doctors taking freebies | | | Early Times Report Srinagar, Mar 15: A Division Bench of Jammu and Kashmir High Court has asked government to inform it whether any enquiry and subsequent action has been taken against doctors who take kickbacks and freebies from pharmaceutical companies. Hearing a Public Interest Litigation, the bench comprising Justice Hasnain Massodi and Justice Dhiraj Singh Thakur observed that petitioner in para-4 of the petition has identified a number of doctors, who, according to the petitioner were found accepting gifts from some pharmaceutical companies. "Additional Advocate General J A Kawoosa (shall) inform the Court regarding enquiry, if any, conducted against the doctors mentioned in para-4 of the petition and the action taken against the erring doctors on the basis of outcome of such enquiry," the division bench said. "Respondents shall also file detailed statement of facts in terms directions issued on 23 December, 2013 with suggestions to control the menace," the bench said further as it posted the PIL for further consideration. In December last year, the Division Bench had restrained doctors practicing in Jammu and Kashmir from accepting any kinds of gifts from Pharmaceutical Companies and asked them not to travel either within the country or abroad at their expenses. The PIL demands action against those doctors who receive cash and gifts from medical companies to prescribe medicine to the patients. The respondents in the PIL include state through Chief Secretary, Commissioner Health and Medical Education, Director SKIMS, Director Health, Principals of GMC Srinagar and Jammu, Medical Council Of India, DGP, IGP crime, Micro Labs Ltd. The PIL filed by three persons from Srinagar through Advocate Qazi Ayaz demanded action against doctors who are involved in the commission and omission of offenses involving receiving of kickbacks and freebies to prescribe the medicine. The petitioners also demand ascertaining assets of such doctors and cancellation of their licenses. They also demand constitution of taskforce to look into such type of offences and also seek black listing of the companies who are offering cash, freebies or Kickbacks. The petitioners also seek action against the representatives who are promoting the corruption in medical profession and also seek imparting of moral education to medical students during their training in medical colleges.
