| Fast track Court awards Life- sentence to rape accused | | | Jammu, Mar 15 (JNF): Presiding Officer Fast Track Court Sanjeev Gupta today awarded life-imprisonment and fine Rs 50,000 to one Nikhil Sharma who was facing trial for the last in kidnapping and rape with semi-mentally retarded 10 years old girl.
After hearing Additional Public Prosecutor for the state whereas Adv PS Pawar for the accused, Presiding Officer Fast Track Court Sanjeev Gupta observed convict had committed a heinous offence in the course of which he waylaid the prosecutrix, a semi mentally retarded girl of 10 years and committed rape with her. Observing the rape cases and cases relating to crime against women particularly pertaining to young female children have alarmingly increased in recent time and in present when it relates to a helpless semi mentally retarded girl requires exemplary treatment, the court awarded rigorous life-imprisonment with fine of Rs 50,000 u/s 376 RPC to Nikhil Sharma s/o Ashok Sharma r/o Gurah Brahmana Tehsil Akhnoor and he is further sentenced u/s 363 RPC and awarded seven years rigorous imprisonment and fine Rs 5000/-. According to the police case that father of the prosecutrix on May 25, 2008 lodged a complaint that he resident of Palwan Tehsil Akhnoor, his daughter aged 10 years left the home to visit her maternal parental house, but she did not return, therefore, he went out in search of her and when he reached near a thoroughfare at 7:00 PM, he saw accused committing forcible sexual inter-course with her daughter under a "puli", who on seeing him fled away from the spot. On this police registered a case and after completion of formalities and enquiries presented challan against Nikhil Sharma s/o Ashok Sharma r/o Gurah Brahmana Tehsil Akhnoor u/s 376/363 RPC.
