Alleged Minor Raped and Kidnapped
HC directed SSP Border to proceed further in the Case

Jammu, August, 04 :- Justice Nirmal Singh of J&K High Court Jammu Wing today after considering the statement of the prosecutrix which was recorded by the Chief Judicial Magistrate Jammu yesterday and sent the same to SSP Border Jammu, who will himself examine the statement of prosecutrix and will proceed further according to law. Court further directed that while examining the statement of prosecutrix SSP will also hear and considered the stand of accused persons. If a cognizable offence is made out, then enquiry/ investigation be handed over to an IPS Officer. With these directions the Court disposed of petition filed by parents of the prosecutrix and as well as the CMP.



In the petition filed through Advocate Nirmal Kotwal, it was submitted that due to poverty petitioners had no sufficient income to on put the family and when the daughter of the petitioner (prosecutrix) was at the age of seven year, Parsem Singh alias Natha r/o Bahu approached the petitioners to utilize the services of the minor daughter for his domestic purposes. It was further alleged that in the month of April, 2006 petitioners who are parents of the prosecutrix went to the house of Natha to know about the well being of the minor daughter and after reaching their found that the daughter was missing. On asking about the whereabouts of her daughter, the private respondents could not give satisfactory reply then approached to the police and only came to know about their minor daughter when minor was sent to Nari-Niketan RS Pura through SP Central Jail Jammu.



It is further submitted that petitioner approached CJM Jammu with an application for medical check-up of their minor, on the direction of directed Medical Supt GMC Jammu to conduct the medical examination of the minor. It is further alleged in the petition on May 29, 2006 the petitioners came to know that the medical report of minor daughter which not only confirm that she was pregnant by eight weeks and also confirmed that she has been regularly sexually assaulted. They filed this petition in the state High Court for registration of FIR against the private respondents who are father and son. On the direction of the High Court RS Pura Police produced the prosecutrix before the High Court and HC ordered CJM for recording the statement of the prosecutrix, the CJM recorded the statement of the prosecutrix in his officer chamber and said the same to the High Court. Today the High Court directed SSP Border to proceed further in the case.
