| Court awards sentence to Bus driver | | | JAMMU, APRIL 04 City Judge Jammu Mr. Pawan Dev Kotwal today convicted and sentenced Suram Singh, driver of bus for two years rigorous imprisonment in an accident case. In the 30 page judgment, City Judge Jammu, after hearing both the sides and considering the record of the case, observed that the evidence of the eyewitnesses does not suffer from infirmities on any material fact, nor any other probability or possibility could be elicited in the cross-examination by the defence. There is not only a strong suspicion of commission of offence by the accused, but a firm belief on the basis of evidence that the accused was driving the said vehicle negligently, carelessly and rashly at the time of occurrence due to which he could not control the vehicle that fell down in the Nallah causing injuries to the passengers and some of them succumbed to injuries. The prosecution has succeeded in establishing the charge against the accused for the offences punishable under sections 279/337/304-A RPC beyond all reasonable doubts, as such, accused is convicted and sentenced to rigorous imprisonment for two years u/s 304-A RPC and sentenced to RI for three months u/s 379 RPC and further imprisonment for three months u/s 337 RPC. Court said that all the sentences shall run concurrently. |
