| ‘IOs lack concept of crime, investigation’ | | CJM acquits accused in tampering case after 20 years | | JAMMU, APRIL 07 Second Additional Sessions Judge, Jammu, Mr. AK Koul today acquitted the accused after 20 years allegedly involved in tampering of date of birth of an employee of the police hospital. In the acquitted, Mr. AK Koul, took serious note of the Investigating Officers and said that whatever material has been placed on record, it revealed that the case failed due to collective carelessness and incompetence of the Investigating officers. If there was any truth in the charge leveled against the accused, then IO’s , are solely responsible for the debacle of the case. Other possibility could be that all this was done to show the accused door. Whatever may be the possibility, accused has lost his job and 20 valuable years and money, and questioned who would compensate him? .He observed that this is a question would probably none from the Police Department could answer. According to the case a letter from SSP Jammu was received in P/S Pacca Danga in October 18, 1986 in which it has been revealed that accused Dalbir Singh, who was working in police hospital, Jammu, was asked to produce his date of birth certificate. In compliance, he produced the school leaving certificate issued by the Head-Master Government Middle School. It was noticed that the date of birth of the accused was overwritten. A case u/s 420/468 was registered and investigating started. After completion of the investigation, challan was presented after 20 years of registration of case on June 2, 2006. Court, after hearing APP for the state and Advocate PS Parmar appearing for the accused, observed that the case has not only failed, but it has exposed the professional excellence of police department. Case has been registered at the behest of a senior police officer, but one does not understand as to how he believed the complicity of accused. Someone else could even have tempered the record. If he got the case registered how he established the guilt of accused. There is neither any direct nor indirect evidence on record o show the involvement of accused Dalbir Singh. Entire evidence, oral as well as documentary, is useless so far as charge against accused is concerned. The investigating officers have demonstrated that they have no concept of crime and investigation. Resultantly the case has failed and is dismissed and accused is acquitted after more than 20 years.
