| DB asks Government to consider opening of B. Ed Colleges | | | JAMMU, APRIL 11 Division Bench of J&K High Court, Jammu Wing, comprising Justice Nisar Ahmed Kakru, Chief Justice (Acting) and Justice YP Nargotra today in a much publicized Public Interest Litigation against mushroom growth of B. Ed colleges in the State has directed the State authorities that applications filed or those may be filed for grant of permission to open the colleges shall be considered and disposed of by the functionaries of the State concerned on the strength of the rules within a period of two months and appropriate orders passed. Upon communication of the said order by the state government to the Universities, the later shall consider the claim of the institutions within one month there after, the Court ordered. . This PIL was filed by Harinder Singh Bangariha and others in 2004 against the mushroom growth of B.Ed colleges in the state. Division Bench, after hearing Advocates Sunil Hali, HC Jalmeria and BD Sundan appearing for the petitioners and Advocate General AH Naik with AAG BS Salathia, Sr. Adv DC Raina and Advocate DS Thakur appearing for the state and other respondents, observed that writ petitions appears to have emanated from failure of the respondents to evolve a criteria for admission to the B. Ed colleges, but essentially a restraint is sought against grant of permission to those who too aim at the education activities like existing ones. During the currency of the writ petitions many motions came to be floated for intervention and impleadment, genuinely so, because interim directions are against them. After hearing counsel for the parties, DB further observed that by now the rules have been framed, obviously permission for grant of opening of new-colleges have to be considered on the criteria laid down in the rules. Counsels for the parties have conceded to the disposal of the petitions at this very stage. Accordingly, all the petitions are disposed of on the terms of the directions mentioned above. With these observations, DB disposed of petitions along with connected CMPs, with interim directions passed from time to time to merge in this order.
