| CJM Kathua rejects bail application | | | Kathua, April 12
Chief Judicial Magistrate Kathua Varinder Singh Bahu today rejected the bail application of an abetment of kidnapping accused against whom investigation was going on in Kathua police station.
The application was moved by Kailash Chander of Kaluchak, who was arrested by the police under section 363/109 RPC. As per the prosecution story the accused helped Rajesh Kumar to kidnap a minor girl from her village in Kathua.
Though the accused was behind bars from March 7, 2007 police was yet to recover the prosecutrix and the other accused and investigation was in progress.
After hearing both the sides, the court observed that being a government employee more reasonability is fixed on the accused. The prosecutrix has not been recovered so far and the allegations leveled against the accused are serious in nature, the court observed while rejecting the bail application of the accused.
