Jammu, May 10 (JNF): Principal Sessions Judge Kathua Vinod Chatterji Koul today rejected the bail applications of two accused who are facing trial in rape case. Principal Sessions Judge Kathua Vinod Chatterji Koul after hearing Advocate B B Bhagotra for the accused persons namely as Khjoor Singh s/o Rattan Singh of Bakhta -Kathua and Harvinder Singh s/o Puran Singh of Dhanni (Berra) Kathua and Public Prosecutor Ravi Kumar Gupta for the state observed that The prosecutrix is alleged to have been raped by the petitioners along with other accused in turns. "It must be kept in mind that rape is a social offence and a rapist cannot claim bail for the reason that his liberty cannot be curtailed, court said. With these observations Court rejected the bail applications. According to the police case that on 7/5/2013, the prosecutrix, reported the occurrence at Police Station Kathua, stating therein that she had been to village Ghati Chung, along with her father for harvest from the land owned by her father. They stayed in a hut constructed in the land. On the sixth day of their stay three persons came there and threatened both of them and asked to leaver the area. On the intervening night of April 29/30, they came there again and threatened her father. Apprehending danger, the prosecutrix ran away however two of them saw her who chased her and caught hold of her. Thereafter both seduced her sexually in a hut situated nearby. A case for offences u/s 376/458 RPC was registered at Police Station, Kathua against the accused who later had applied for bail. |
