Jammu, May 10 (JNF): Principal Sessions Judge Kathua VC Koul today awarded four year imprisonment and fine Rs 10,000 to one Akhter Hussain of Shakargarh,Distrtict Narowal, Punjab, Pakistan who was facing trial u/s 14 Foreigners Act. When the hearing was taken up in court today after listening both sides, Principal Sessions Judge Kathua VC Koul today awarded four year imprisonment and fine Rs 10,000 to Akhter Hussain S/O Sharief R/O Madzeal, Tehsil Shakargarh,Distrtict Narowal, Punjab, Pakistan. After hearing Public Prosecutor Ravi Kumar Gupta for the state whereas Advocate Sunita Devi as Amicus Curie for accused, Principal Sessions Judge Kathua VC Koul observed that so far as the evidence on record is concerned, it is established that accused, who is admittedly a Pakistani National had entered the territory of India after crossing the International Border on Oct 3/4, 2013, without any permission or authority. Court also observed that the accused having been held guilty and the charge having been proved, as such, he is convicted for offence punishable under Section 14 (A) (b) of The Foreigners Act and keeping in view all the facts and circumstances, he is sentenced to undergo imprisonment for a period of four years and also to pay a fine of Rs. 10,000/-in default of payment of fine, the accused shall further undergo imprisonment for a period of six months. According to the police case that a complaint was lodged with the SHO, Police Station, Rajbagh, by Company Commander, F Coy, 68 Bn. BSF. As per the report on 04/10/2013 at about 1305 hours, HC Satyawan Singh Dangi and Ct Bharat Singh at OP duty EX-BOP, Paharpur observed some suspicious movement in Sarkanda near BP No. 5 near Phag Nallah on Indian side of International Border. They opened fire and subsequently, a search of the general area, was carried out and at about 1400 hours, the accused with two bullet injuries was apprehended. The accused was evacuated to Jammu for treatment. On the basis of this written report, police of Police Station, Rajbagh, conducted investigation in this case and found offence punishable u/s 14 Foreigners Act proved against the accused and filed the charge sheet. |
