| CJM dismisses application of accused involved in Chopra murder case | | | JAMMU, APRIL 17 Chief Judicial Magistrate, Jammu, Mr. Sanjay Dhar, today dismissed the application filed on behalf of accused Rusi Pardi and Mahesh Pardi real brothers, residents of MP, allegedly involved in the much publicized Chopra murder case. Court on March 28, 2007 had granted bail to the accused subject to furnishing bail bond with two sureties of Rs 50,000 each, the accused seeking modification in the order and filed the application through Adv Ajay Gupta. CJM while rejecting the application referred various judgments of the Supreme Court and said that the accused are alleged to be involved in famous Chopra murder case in which three members of the family and their servant was done away within their own house in the darkness of night. The murder shocked the conscience of Jummuites and it sent shivers down the nerves of all and sundry. The investigation of the case is still going on and the investigating agency is trying to unravel the murder mystery, hence the presence of the accused before the Investigating Agency at this crucial juncture is must. CJM further said that accused have got the bail by default, as the investigating agency could not wind up its investigation within 60 days of the custody of accused. Keeping in view the sensational and serious nature of offence in which accused are allegedly involved, it was incumbent for this court to impose such conditions, as would be sufficient to ensure the presence of accused before the investigating agency. It is also to be borne in mind that accused came to be arrested from Madhya Pardesh after a warrant of arrest was issued by this court and the J&K Police had to camp for weeks together in MP in order to effect the arrest of the accused, as is borne out from the case dairy. If the accused are let off on execution of personal bonds or on payment of cash security of Rs 2000, as has been suggested by the counsel for the accused, there is every likelihood that accused may not become available for investigation. After the points raised by CPO Mr. MA Manhas, the CJM said that the conditions imposed on accused while granting bail to them vide order dated March 28, 2007 are neither unreasonable nor illegal, hence the same calls for no modification. With these observations court dismissed the application filed by the accused persons. JNF
