| HC stays deputation of 43 MVIs to MVD | | |
JAMMU, APRIL 18 Justice Nirmal Singh of J&K High Court, Jammu Wing, today in a writ petition challenging the deployment of 43 Motor Vehicle Traffic Assistants of JKRTC (Jammu & Kashmir Road Transport Corporation) on deployment to Motor Vehicle Department as Motor Vehicle Inspectors (MVI) has stayed the operation of order No 69-TR of 2006 dated December 15, 2006 and notification SRO 88 of March 16, 2007 till further orders. In the writ petition filed by Sudershan Kuma, the Court had directed respondents to file objections, which have not been filed despite acceptance of notice by the Deputy AG Mr. AS Dogra appearing for the official respondents. The case projected by the petitioner that official respondents have issued government order No 69-TR of 2006 dated December 15, 2006 by which private respondents numbering 43 have been directed to work as Motor Vehicle Traffic Assistants in their own pay and grade and another notification issued on March 15, 2007 bearing SRO 88, vide which the junior inspectors of JKRTC on deployment to Motor Vehicles Department have been directed to perform the duties of Motor Vehicle Inspectors. It is stated that this has been done in violation of SRO 443 (E) of 1989 dated June 12, 1989 issued by the government. The petitioner further submitted that earlier also the State Government had deputed Junior Inspectors to MVD and had directed them to perform the duties of Motor Vehicle Inspectors, this action of the state was challenged and High Court allowed the petition vide order dated April 10, 2002 with the observations that the stop-gap arrangement shall not be permitted to continue beyond three months as indicated in the order. Nothing is said vis-à-vis the qualification of the private respondents. That aspect of the matter is left to the determination of the Board. Adv Abhinav Sharma appearing for the petitioner submitted that the respondent now firstly issued the SRO and objections have been called subsequently and this has been done only to accommodate few persons who were earlier directed to join and perform the duties of Motor Vehicle Traffic Assistants in the Motor Vehicles Department. Justice Nirmal Singh taking into consideration all these facts ordered that the operation of order impugned and SRO 88 shall stand stayed till further orders.
