Consumer Commission directs for issuance of fresh SLC
Directs Principal to pay Rs.40, 000 as compensation to Jagga Ram

The Jammu and Kashmir State Consumer Redressal Commission, has directed Principal Jai Hind Public School Kathar Manwal Jammu, to issue a fresh School Leaving Certificate (SLC)/ ‘certificate of achievements’, within a period of two weeks in favour of Rajesh Kansal alias Sunny son of Jagga Ram, with further directions that ZEO Dansal Jammu, the respondent NO 2, shall render all possible help for its issuance.
The Commission also directed the Principal to pay Rs.40, 000 along with Rs.5000 as cost of proceedings to Jagga Ram of Railway Colony Roun Domail Udhampur, a peon in Northern Railway Udhampur.
Justice Mr. G D Sharma President of the Commission with Mr. Khalid Hussain as Member, while disposing off the Appeal filed by Jagga Ram of Railway Colony Udhampur and revision petition filed by Principal of the School challenging Divisional Forum order dated April 23, 2005, observed that the said order is found of no legal consequences as the basic order dated of June 5, 2004 has been upheld and subsequent order dated March 5, 2005 has been set aside after finding it illegal. The Commission observed that the impugned order in the revision petition dated April 23, 2005 which is an off shoot of the order dated March 5, 2005 automatically dies with the death of latter.
Jagga Ram, working as class IV in Northern Railway, had admitted his son Rajesh Kansal @ Sunny in Jai Hind Public School Kathar Manwal and on his transfer to Roun Domail Station in Udhampur, he had applied for school leaving certificate of his son for getting fresh admission in a nearby school in Udhampur.
The certificate issued by the School bore no seal and signatures more so it was not countersigned by the ZEO concerned as a result his son could not get admission. He, in his petition, maintained that because of the deficient service rendered by the Principal, the respondent, his son was forced to discontinue his studies for onward academic session from 2003-04 till date and is sitting idle at his native place. Had the original certificate being in his possession, he would have sought admission of his son in a new school in Roun Domail area, Jagga maintained in his appeal.
Justice G D Sharma, after hearing all the parties and perusing the records, observed that the Respondent, Principal, is under the bounden legal duty to issue school leaving certificate or ‘certificate of achievement’, which serves the purpose of continuation of further studies and his failure to do so has affected the future studies of the boy which needed to be compensated.
The Commission uphold the order dated June 5, 2004 passed by the Forum with a modification that awarded amount against respondent No 1 is enhanced from Rs.25000 to Rs.40000, besides bearing the cost the costs of proceedings before the Forum and the Commission quantified jointly at Rs.5000 and also issued directions for issue of a fresh school leaving certificate within a period of two weeks from its service in favour of Rajesh Kansal @ Sunny.
