| DB takes serious note of non-appearance of Com/Secy. Finance | | | JAMMU, APRIL 20
Division Bench of J&K High Court, Jammu Wing comprising Justice Nisar Ahmed Kakru, Chief Justice (Acting) and Justice Virender Singh, in an LPA filed by the State against the order of Single Judge in a writ petition filed by the High Court Staff Welfare and Others, has taken serious note of non appearance of Commissioner Secretary Finance.
The Bench on March 8 last had directed that in case sanction order is not placed on record, then Commissioner/Secretary Finance, as well as Mr. AH Kochak, Secretary Law should appear in person on next date of hearing.
The Commissioner/ Secretary (Finance) and Law Secretary have failed to place on record the sanction order, failure makes their appearance imperative, the DB observed..
DB, after hearing Adv PN Raina for the appellants and Mr. Joginder Singh General Secretary High Court for Staff Welfare Association, took serious note of non-appearance of Commissioner/ Secretary (Finance), observed that Commissioner/Secretary Law Department is present whereas Commissioner/ Secretary (Finance) has opted for oblivion and his non-appearance is sought to be justified on the strength of communication gap. No explanation much less satisfactory one is advanced, giving cause for issuance of warrants against him. However, in view of the statement made by Adv PN Raina appearing for the appellants that the sanction is expected within a short span, a lenient view is taken and time for four weeks granted, the DB observed.
