| HC Stayed proceedings in alleged Timber Scam | | | JAMMU, APRIL 20, 2007 Justice Mansoor Ahmed Mir of J&K High Court Jammu Wing today has stayed the proceedings in much publicized multicrore timber scam.
Justice Mansoor Ahmed Mir in a writ petition filed by Baldev Singh Syal of Syal Enterprises against Central Bureau of Investigation in which Advocate SK Anand appeared, court issued notice to CBI returnable within two weeks. Keeping in view averments contained in the main petition read with CMP and the submissions made by Adv SK Anand, Court stayed the proceedings till next date of hearing.
In another writ petition filed by Kuldeep Singh of M/S National Timbers and Mustaq Ahmed of M/S Classic Timber Traders in which Sr. Adv ZA Shah appeared, Justice Mansoor Ahmed Mir after hearing Sr. Adv issued notice returnable within two weeks.
In the petition filed through Adv SK Anand u/s 561-A CrPC for quashing the proceedings initiated by CBI u/s 420/ 467/ 468/471 and 120-B of RPC and final report was filed in the court of CJM Jammu whereby the court framed charges.
In the petition it has been submitted that Public Interest Litigation was filed in the High Court. The petitioners were not parties in the said PIL vide order dated September 12, 2005, the CBI was directed to register a case. Earlier the case was registered by the Crime Branch Jammu on the basis of complaint filed by one VK Gupta (retd ACF). The CBI after investigation the case submitted its report before the court of Special Magistrate CBI (CJM). The Trail court vide its order February 12, 2007 framed charges against the petitioners u/s 420/511, 468, 471 and 120-B RPC. The petitioner submitted that FIR 24/2005 registered by Crime Branch Jammu and FIR NO 4 of October 1, 2005 registered by CBI and final report submitted in the court of CJM. The petitioner seeking quashment of proceedings on the ground that out of 5416 timber scants supplied by the timber merchants, the CBI during investigation found that 122 scants are sub-standard and the accused Gurdeep Singh falsely indicated that the measurement 5416 numbers of timber scants was 595 cubic meter when according to the committee timber scants found to be 457.718 cubic meters. It is stated that in this manner dishonestly and fraudulently 29% more value was shown of Rs 28.06 laces. Regarding making of payment to the officers of quality control for showing favour to accept sub-standard timber is also not found substantiated and the allegations that the timber other than State Forest Corporation Source was supplied has not been found proved beyond reasonable doubt.
