JAMMU, June 16: High court today stayed promotion of Associate Professor in Surgery with direction to the state to file objections.
In a petition filed by Dr. Ratnakar Sharma, presently Assistant Professor in Department of Surgery in GMC Jammu stated that the private respondent Dr. Sanjay Kumar, presently Assistant Prof GMC Jammu belongs to SC category and the petitioner apprehends that the private respondent may be promoted as Associate professor being a reserved category candidate and above the petitioner who is senior to private respondent, following the provisions of the J&K Reservation Rules 2005 which is contrary to the judgment of Apex Court.
Justice Dhiraj Singh Thakur issued notice to the Commissioner\ Secretary Health & Medical Education and J&K, PSC through its secretary and Dr. Sanjay Kumar returnable within four weeks. Meanwhile, court ordered that subject to objections and till further order, it is provided that the official respondents shall not make any promotion/Incharge arrangement on the basis of reservation provided in the J&K Reservation Rules 2005.
