| BBIA challenged increase in electricity charges 25 to 50% | | HC directed to pay the tariff as per impugned order | | JAMMU, APRIL 21, 2007 Justice Mansoor Ahmed Mir of J&K High Court Jammu wing in a petition filed by the Bari-Brahamana Industries Association challenging increase in the electricity charges from 25 to 50 percent, issued notice to Power Development Department through Development Commissioner and Jammu & Kashmir State Electricity Regulatory Commission and also called the record.
Justice Mansoor Ahmed Mir after hearing Sr. Adv ZA Shah with Adv Vipin Gandotra appearing for the association disposed of CMP with the direction that appellants shall pay the tariff as per the impugned order but with the command that respondents shall indicate in the bill that what tariff was payable previously and what is now payable as per the impugned order and shall maintain the account of the differential accounts. However, this order is subject to the outcome of the main appeal and shall not prejudice the rights of the appellants in anyway.
The Bari-Brahamana Industries Association filed a writ petition in the state High Court challenging the order dated March 28, 2007 passed by the J&K State Electricity Regulatory Commission. The impugned order has resulted in increase the retail supply tariff payable by the appellants and similarly situated electricity consumer in the state by about 25 to 50 percent. In the petition it has been alleged that the said increase steep and contrary to all the principles of rationalization of tariff whereas PDD has not furnished any details or justification for increase in tariff and prayed for stay of the operation of impugned order dated March 28, 2007 passed by the J&K Electricity Regulatory Commission.
It is worthwhile to mention here that in the petition, petitioner mentioned a detailed issued by the PDD regarding the metered/unmetered installations as on March 31, 2005, according to this table up to above mentioned dated in the Jammu metered installations are 2, 44,177 unmetered 2, 83, 073 whereas in the Kashmir metered installations are only 23162 and unmetered 6, 12, 873 and the total installation in the state are metered 11, 63, 285 as per the data issued by the state up to Marc 31, 2005. |
