| HC stays appointment of Registrar Ayurvedic medicine | | | Early Times Report JAMMU, June 25 : High Court today stayed the appointment of Dr. Rakesh Kumar as Registrar of the Ayurvedic and Unani medicine. Vacation Judge of High Court Janak Raj Kotwal in a petition filed by Dr. Chatru Ram challenging the appointment of Dr. Rakesh Kumar, Assistant Director, Indian Systems of Medicine, as Registrar of the J&K Board of Ayurvedic & Unani Medicine after hearing Sr. Advocate MK Bhardwaj assisted by Adv Aditya Sharma appearing for the petitioner stayed the order dated May 15, 2014 till final decision if accorded of approval to the appointment of the petitioner is taken. According to the Case projected by the petitioner, the post of said Registrar stands advertised vides Notification no. ISM./Pr./Board/J&K 309 dated 03.02.2014 and pursuant thereto, the President, Board of Ayurvedic and Unani Systems of Medicine, J&K, Jammu has issued appointment order of the petitioner dated 20.05.2014 against the said post subject to approval of the Administrative Department. It is contended on behalf of the petitioner is that the Administrative Department has deliberately delayed the approval to appointment of the petitioner and has appointed private respondent temporarily to further delay the petitioner's appointment. It is alleged in the petition that Dr. Rakesh Kumar never participated in the selection process and without doing so he has been appointed as Registrar. Justice JR Kotwal after hearing Sr. Adv MK Bhardwaj issued notice to Commissioner/Secretary health & Medical Education Department, J&K Board of Ayurvedic & Unani Medicine through its President, Director ISM Srinagar, Deputy Secretary health & Medical Education Department and Dr. Rakesh Kumar returnable within four weeks and in the meanwhile subject to objections and till next date before the Bench, impugned order dated 15.05.2014 shall stay till final decision in accord of approval to appointment of the petitioner is taken.
