| DGP rules out VDC involvement in Lassa Khanday killing | | Kishtwar communal riots | | Early Times Report
Srinagar, June 26: The police have denied role of Village Defence Committee (VDC) members into killing of Lassa Khanday, a civilian whose body was found at helipad in Padder Kishtwar last year during the communal riots. In response to the letter of SHRC bearing number 2013/174/2099 dated August 19, 2013, the Director General of Police (DGP) has said: "The enquiry got conducted into the matter reveals that after communal riots at Kishtwar on August 9, 2013 the members of a community took out a protest rally at Paddar and damaged the shop of one member of another community. The protesters had thrown out all the items of the shop and burnt them. The report further reveals that next day on August 10, 2013 members of a community took out a procession from Athol Paddar. Similarly members of another community of village Jijai came out of their houses and took out a protest march. The procession of one community also reached near Kijai Bridge and pelted stones upon the houses of another community. In retaliation the members of another community also pelted stones upon the protesters. The members of VDC Kajaiee fired some shots in air. On this the protesters dispersed and went towards village Karthaie. In the meanwhile the members of the one community blocked the road at Kajaiee. There was exchange of fire between VDC members of Kajaiee and one VDC member of Hanswarch got injured." The injured VDC members were taken to hospital for treatment and after giving first aid the seriously injured persons were referred toKishtwar/Jammu for further treatment. The DGP has informed the SHRC that the enquiry report also reveals that when the seriously injured persons were being taken to Helipad Padder for their further shifting to Kishtwar/Jammu through chopper, one Lassa son of Mahmadoo Khanday was also accompanying the injured in the ambulance as an attendant. "When the ambulance reached near Helipad, a provocative mob of a community tried to attack the ambulance. The police tried to control the mob and even fired some gun shots in the air but the mob damaged the fencing of the Helipad and forced their entry into the premises. They broke the door of the ambulance and dragged out Lassa son of Mohmadoo Khanday from the ambulance. The protesters taking the advantage of the heavy rains took Lassa to some distance where he was beaten up severely due to which he died and his dead body was thrown near the helipad. In this connection a case FIR number 17/2013 under section 364, 307, 147, 148, 336 427, 34 RPC stands registered in police station Atholi. After completing all legal formalities including post mortem the dead body was handed over to his legal heirs for last rites." Report further adds that deceased Lassa son of Mohammadoo Khanday was not killed by the VDC members but was skilled by the provocative mob at Helipad Padder. Moreover during the post mortem of the deceased no sign of gun shots were observed on his body, during investigation it came to surface that there is no VDC member at Gulabgarh Padder where the deceased was killed and the allegations of killing of Lassa son of Khanday by VDC members are not based on facts." "The investigation of the case FIR number 17/2013 has been concluded as proved against 10 accused persons of whom two accused persons have been arrested and are facing trial. In respect of the rest of the accused the case been charge sheeted under section 512 Cr.Pc." The SHRC had taken suo moto cognizance of the killing of a civilian and four injured others in Padder-a remote area of Kishtwar which took place following communal tension last year in the month of August 9, 2013. |
