DB grants two weeks time to file report on 'Agriculture land conversion'
Stays earth filling in 'Narkara wetland' in Srinagar

Srinagar, June 30: Jammu and Kashmir High Court today granted two weeks to four Deputy Commissioners from Jammu and three from Kashmir to file status report in compliance to its directions about the conversion of agriculture land in their respective districts. Meanwhile court also stayed earth filling in Narkara wetland in outskirts of Srinagar.
While hearing a Public Interest Litigation, a Division Bench (DB) of the court comprising Chief Justice M M Kumar and Justice Hasnain Massodi granted the time following submissions by Advocate General M I Qadri. During the hearing the it was submitted that status reports have been filed by Deputy Commissioners of various districts but three DCs of Budgam, Anantnag and Kulgam from Kashmir province and four DCs from Jammu provinces including Kathua, Rajouri, Udhampur and Kishtwar have not been able to file status report in terms of order dated 10/4/2014 and 6/5/2014.
He said that same shall be done within two weeks with copy in advance to amicus.
"The amicus may file response within the two weeks following next," the court said and posted the case in the month of August.
In another direction, the court also stayed construction over the agriculture and behind court complex Pampore in south Kashmir's Pulwama district.
Pertinently, in last direction, the Court had directed authorities to ensure timely and stern action against violators.
"It is a matter of concern that the Revenue authorities having powers under various enactments to stop violation of conversion of the land are not taking timely action, as a result the violators with impunity have been changing the kind of land," the court had said.
The court was hearing the PIL seeking directions for preventing conversion of agriculture land from being used for any other purposes for which it is meant.
"All the Deputy Commissioners (Collectors) of the districts are impressed upon to ensure that all the Revenue authorities at their respective levels shall ensure stern action against the violators so as to stop the change of the agriculture land," the court had said.
Meanwhile, the court also stayed earth filling in Narkara wetland in outskirts of Srinagar.
"We have been informed that this is a wet land and earth filling at the instance of encroacher is in progress. We direct that any earth filing shall remain stayed till further orders and if any violation of our order is found the same be reported so that violators be dealt with sternly," the bench said.
