| HC seeks status report on use of sub-standard material in road construction in Kashmir | | | Early Times Report
SRINAGAR, July 10: High Court has directed state government to file status report regarding the measures in place to prevent use of used mobile oil in macadamization of roads in Kashmir valley. Hearing a Public Interest Litigation, a division bench of the court comprising Justice Virender Singh and Justice Hasnain Massodi asked government to file the status report within four weeks. The direction followed submission by amicus curie in the PIL that there are large scale complaints that private contractors are using used mobile oil with tarcoal so as to save the tar which is ultimately sold in the market. He requested that a complete mechanism should be put in place so that all the macadamization projects are monitored and checked. Earlier, National Highway Authority of India filed a report that no used Indian oil has been utilized in macadamisation work of Qazigund-Srinagar road. The court had directed the NHAI that If the Information was correct then it has to take notice of this fact and bring the officers, responsible for committing such type of lapse, to the books, which obviously would be the act of misappropriation and deception. "Amicus Curiae, does not intend to file any response to it, therefore, this aspect does not warrant any further direction from the Court," the bench said. In another direction, the court also granted four weeks time to Indian Oil Corporation Ltd. to file status report regarding setting of Auto LPG units in the Valley. On the last date of hearing, the court had sought the report after Transport Commissioner of J&K filed Status report in pursuance of the directions issued on May 13 last, disclosing that in response to the letter sent by his office, a communication has been received from the Indian Oil Corporation Ltd. wherein it is stated by the Corporation that required formalities are being done and necessary statutory approvals are being obtained for installation of Auto IPG dispensing outlets in Kashmir. "The response given by the Indian Oil Corporation is not only vague and cryptic but does not disclose any progress made, therefore, impleadment of the Indian Oil Corporation Ltd as a party respondent is necessary," the court had said. Accordingly the court had impleaded Indian Oil Corporation Ltd through its Deputy General Manager Madya Marg Chandigarh as party respondent so that effective directions are issued to the Corporation. |
