BOPEE Scam: HC again pulls up CB for its failure to arrest absconders

Srinagar, July 24: A Division Bench of Jammu and Kashmir High Court has pulled up the Kashmir wing of Crime Branch (CB) of police for failure to arrest 7 absconding accused in the multi-million paper scam in Common Entrance Test 2012.
"The number of persons arrested has risen to 10 out of 17 as reflected in the last order on 1-7-2014.
We record our displeasure with regard to the method adopted towards the arrest which has hampered the trial and investigation of FIR," the division bench comprising Chief Justice M M Kumar and Justice Hasnain Massodi said.
At this point, Advocate General M I Qardi stated that arrest of five students and two of their parents shall be affected at the earliest, possibly within a week's time.
"Show cause notice have been issued to the employees who are involved in the scam and action is likely to be taken against them," the advocate general said. "Action taken report be filed on next date of hearing," the court said.
It also directed Special Judge Anti Corruption Kashmir to file latest progress report about the trial. Earlier, the judge filed progress report from 8 January 2014 to 2nd of July.
In respect to investigation in CET 2009, 2010 and 2011, court asked Crime Branch to file the latest status report.
"In 2009 and 2011, there was no evidence, therefore the investigation agency is to close the investigation.
We are unable to appreciate how investigation in respect of admission made with respect to 2011 could be closed when the evidence is readily available in respect to admission made in year 2010," the bench had said.
The advocate general had stated that some more time shall be given to collect evidence in respect of year 2009, 2010 and 2011 and a fresh report accordingly shall be submitted. The court has already directed the Cellular companies like BSNL, Vodafone, Airtel, Aircel and others to cooperate by furnishing information required by the investigating officer.
