Court rejects closure report of VOJ, directs further probe

Jammu, Aug 9 (JNF): In a much publicized disproportionate assets case against Ashwani Kumar then Junior Engineer PDD M&RE Division Poonch, Additional Sessions Judge Anticorruption Jammu Sanjay Parihar expressed his dissatisfaction over the Ikhtami (final report/closure report) and directed Vigilance Organization Jammu (VOJ) to make further investigation of the case and take the case to its logical conclusion. Additional Sessions Judge Anticorruption Jammu Sanjay Parihar after having gone through final report submitted by VOJ, observed that Court failed to understand as to why the investigating officer has not dealt with aspect and has proceeded to close the case as not admitted. Taking serious notice of this, the court said that investigation into the conduct of the official has been going for the last eight years and the pendulum of investigation has been swinging from one to another without yielding any fruitful result. Court further observed that even supervisory officers have been found lacking in discharge of their duties of the fair investigation which they owe not only to themselves but also to the public at large. Court said that the investigation has been closed as not admitted at the behest of Central Office of Vigilance Organization a premier agency having exclusive control of Vigilance Organization and given material collected during the investigation that had all the elements of the case been concluded as admitted has rather been ordered to be closed as not admitted for the reasons best known to then organization itself. With these observations Court disallowed the Ikhtami (final report/closure report) and directed VOJ to make further investigation of the case and take the case to its logical conclusion. As per case report the Vigilance Organization Jammu (VOJ) registered FIR on September 20, 2006 in which it was found that Ashwani Kumar by way of indulging in corrupt practices and Benami transaction owned huge wealth which is for beyond his known source of income. During a secret inquiry it was revealed that Ashwani Kumar has raised and acquired the assets like a land and house in Poonch Town, a two storey luxurious house at Plot measuring 40/80 in Sector 5 Trikuta Nagar Jammu a plot of land measuring 40/80 in Sector 5 Trikuta Nagar adjacent to the house. A three storey hotel under the name Pine View in a piece of land measuring 3 kanals and 14 marlas acquired in the name of his wife at Kud and car and two wheeler besides investment in movable items such as gold jwellary, bank deposits.
