Accountability commission recommends stern action against another bureaucrat

Jammu, April 30
The state Accountability Commission has recommended stern punishment to Registrar cooperative Societies J&K .G.N.Qasba under section 30 of J&K Civil Services (Classification, Control and Appeal) Rules of 1956 after charges of mal-administration, nepotism and favoritism were proved against him.

As per the order issued by the commission, One Deep Singh, President People Action Accountability, filed a complaint, alleging that the employee Qasba extended an undue favour to the key accused in Rupees 50 lakh misappropriation case Mohd Ayub Reshi Junior Assistant in the office of Dy.Registrar (Agri) Cooperative Societies, Srinagar, by reinstating him while superceding his HOD.

Ayub had misappropriated the amount by issuing a cheque for Rs. 50 lacs in favour of a nonexisting person, Mohd Yusuf Dar.

The whooping sum was later withdrawn by the Junior Assistant Mohd Ayub Reshi, by opening a fictitious account at Chhanapura Branch of State Cooperative Hank, Srinagar.

On the facts coming to the notice of then Registrar Cooperative societies, Junior Assistant, Mohd Ayub Reshi was placed under suspension and an enquiry for fraud and misappropriation of Rs.50 lacs was ordered against the delinquent official.

However, the respondent GN Qasba who at that time was Addl. Registrar Cooperative societies Kashmir revoked the orders of suspension against the accused official violating the orders of his Head of the department.

The complaint further alleged that although the order of suspension and enquiry was issued by the head of the Department, the then Registrar Cooperative societies G N Qasba, who was holding the post of Additional Registrar, without either any prior permission of the Head of the Department or without the matter being referred revoked the order of suspension and permitted reinstated the delinquent of1icial while treating the period of suspension as on duty.

"The respondent, Mr. Qasba, who was associated with the enquiry, was provided full opportunity to project his defence and to refute the allegations in order to ensure the principal of natural justice and fair play".

The complainant succeeded to establish that Mr. Qasba, as Additional Registrar had revoked the order of suspension, when actua1y the Registrar Cooperative societies J&K, the Head of" the Department, was ceased of the matter and had placed the delinquent official under suspension, pending enquiry.

'I'he Commission, accepting the pleas of the complainant observed that Qasba, as Add1.Registrar had no jurisdiction to interfere in the enquiry proceedings or to revoke the order of suspension.

Terming the act of GN Qasba as being motivated with impropriety and to confer favour on the delinquent Junior Assistant, the commission upheld the allegations as defined by section 2,(3)(a),(3)(b),(3-)(c).and (3)(d) and section 2( 1 O)(a) of the J&K Accountability Commission Act,2002.

Taking serious note of the mal-administration, nepotism and favoritism proved before the Commission, Accountability Commission has recommended "punishment, stern in nature, as provided by Rule 30 of the J&K Civil Services,(Classification, Control and Appeal)Rules 1956" against the respondent G.N. Qasba .
